Lucky Little Riders Riding Instruction Agreement

This is our training agreement: program details, lesson terms, cancellation policy, and the standard equine liability release.

Lucky Little Riders LLC — Youth Riding Instruction Agreement

1. Purpose of Agreement. Rider is a minor, and Parent wishes for Rider to ride and handle one or more horses for recreational purposes as part of a riding instruction program and associated activities conducted by Instructor. In consideration for Instructor providing riding instruction to Rider and permitting Rider to ride and handle horses as part of Instructor's lesson program and associated activities, Parent agrees to release and indemnify Instructor and certain other parties from all claims as set forth in this Agreement.

2. Parent's Representations and Warranties. Parent makes each of the following representations and warranties on behalf of Parent, Rider and their respective guardians, heirs and assigns (collectively, the "Rider Parties"): (a) Parent is at least 18 years of age and has the requisite authority to enter into this Agreement; (b) Rider does not have any physical or mental conditions that may prevent Rider from safely mounting, dismounting, riding, leading, grooming or otherwise being around horses; (c) Rider is not under the influence of drugs or alcohol.

3. Lesson Programs. Instructor offers Private Lessons (30-60 minutes), Semi-Private Lessons (1-2 riders, 60 minutes), Group Lessons (2-5 riders, 60-90 minutes), Mommy & Me Pony Club, and Pony Camp. Prior to beginning lessons, Instructor will meet with Parent and Rider to discuss Rider's goals.

4. Instructor Offers No Warranty. Instructor offers no guarantee or warranty of any kind. While Instructor will develop a lesson program designed to meet Rider's goals, Instructor can offer no guarantee that such goals will be met within any time period, or at all.

5. Lesson Cancellations. To receive a refund or free reschedule for a missed lesson, Parent or Rider must notify Instructor at least 24 hours in advance of the scheduled lesson. Cancellations made less than 24 hours before the lesson, and no-shows, are non-refundable, and the full lesson fee is retained by Instructor. Instructor may, in its sole discretion, grant a refund or reschedule for a cancellation inside the 24-hour window in cases of genuine emergency, illness, or other extenuating circumstance. Instructor may reschedule or cancel based on weather, horse availability, or other reasons.

5A. Pony Camp Cancellations. Pony Camp registrations require a 50% deposit at the time of booking. To receive a full refund of the deposit, Parent or Rider must notify Instructor at least 14 days (336 hours) in advance of the camp's first scheduled day. Cancellations made less than 14 days before the camp's first day are non-refundable, and the full deposit is retained by Instructor. The remaining balance becomes due 14 days before camp begins and is also non-refundable once paid, except as provided below. Instructor may, in its sole discretion, grant a refund or credit for a cancellation inside the 14-day window in cases of genuine emergency, illness, or other extenuating circumstance documented by Parent. If Instructor cancels a camp session for any reason — including weather, illness, horse availability, or insufficient enrollment — Parent will receive a full refund or credit at Parent's election, regardless of when the cancellation occurs.

6. Instructor's Discretion to Change Horses. In Instructor's sole discretion, Instructor may change the horse that Rider rides during lessons without advance notice.

7. Horse Behavior. While Instructor will make reasonable efforts to evaluate horses' suitability for Rider, Instructor can make no guarantees. Horses are large flight animals with minds of their own, and even the most well-trained horse can act in unexpected ways including running at high speeds and suddenly bucking or rearing violently.

8-10. Competitions and Payment. Training fees apply for competitions. All lesson payments are due in full at the time of the lesson (or at first lesson of the month for monthly packages).

12. Consent to Medical Treatment. If Rider is injured during horse-related activities and not conscious or with impaired judgment, Parent authorizes Instructor and employees 18+ to consent to medical or dental care for Rider. Parent agrees to reimburse Instructor for treatment costs even if insurance does not cover.

13.1 Safe Behavior. Parent agrees that Rider will follow all instructions, barn rules, and use tack and equipment only as directed.

13.2 Safe Riding Attire. Rider must wear heeled boots, long pants, a long-sleeved shirt and gloves designed for riding, and an ASTM certified safety helmet fastened securely. Instructor has no duty to provide safety attire.

13.3 Risk of Loss to Personal Property. Parent expressly assumes all risks of bringing personal property to the lesson facility, including the risk that Instructor Parties may be negligent.

13.4 Risk of Injury or Death (KEY CLAUSE). Parent understands that horse-related activities, even under the supervision of an equine professional, are inherently dangerous and expressly assumes the risks associated with Rider handling, caring for and riding horses. Parent expressly assumes all risks of Rider engaging in horse-related activities, including the risk that the Instructor Parties may be negligent. Parent agrees not to sue the Instructor Parties or otherwise make a claim against such parties in connection with any injury or death.

13.5 Waiver of Unknown Claims. Parent agrees to waive all rights that Parent might otherwise have under state laws or regulations designed to prevent waiving of unknown claims.

13.6 Indemnification. Parent agrees to defend, indemnify and hold the Instructor Parties harmless against all claims, demands, and causes of action, including costs and attorneys' fees, arising from any action by the Rider Parties or brought against the Instructor Parties in connection with the Rider's participation.

15-16. Governing Law. This agreement is governed by California law. Any legal action must be brought in Ventura County. The prevailing party recovers attorneys' fees and costs.

Property Owner Release of Liability

Lucky Little Riders operates on land owned by Timothy James McGrath. He requires a separate release from every family who comes onto the property. This protects the property owner separately from your agreement with Rebecca.

Equestrian Hold Harmless Waiver and Release of Liability

I. Parties. Releasor: Timothy James McGrath (Property Owner, 141 Sundown Rd, Thousand Oaks, CA 91361) and Rebecca Menco (Operator, 1855 Brian Court, Thousand Oaks, CA 91362). Releasee: the Rider(s) named above, by their Parent or Legal Guardian.

II. Acknowledgment of Inherent Risks. The Releasee acknowledges and understands that equestrian activities (including riding, handling, training, and being in the proximity of horses) are inherently dangerous, regardless of precautions taken. Horses are unpredictable animals. Risks include but are not limited to: injury from falls, kicks, bites, or strikes; injury from equipment failure; injury from collisions; injury resulting from horses reacting to sights, sounds, or unforeseen events; and property damage to personal belongings. Releasee voluntarily participates with full knowledge, understanding, and appreciation of these risks.

III. Assumption of Risk. Releasee willingly agrees to assume full responsibility for any and all risks, injuries, or damages, known or unknown, which they may incur as a result of their participation in activities or presence on the equestrian property located at 141 Sundown Road, Thousand Oaks, CA 91361.

IV. Hold Harmless and Release. In consideration for being permitted to enter the property and/or participate in equestrian activities, Releasee agrees to waive, release, discharge, indemnify, and hold harmless the Releasor, their agents, employees, officers, directors, volunteers, and representatives (collectively the "Released Parties") from any and all claims, demands, causes of action, liabilities, and damages arising out of or related to Releasee's presence on the property or participation in equestrian activities. This includes claims for personal injury, property damage, or death caused by or alleged to be caused by the negligence of the Released Parties, or the negligence of any other person, or due to the condition of the premises.

V. Indemnification. Releasee agrees to indemnify (pay for) and hold harmless the Released Parties from any loss, liability, damage, or cost (including attorney's fees) they may incur due to Releasee's presence on the property or participation in activities, whether caused by Releasee's negligence or otherwise.

VI. Governing Law and Severability. This Waiver is governed by California law. If any part is found invalid, remaining terms remain in full force and effect.

VII. Signatures. The Releasee affirms they are of legal age and have capacity to contract, or are signing as Parent/Legal Guardian of a minor participant. Releasee has read this document, understands its terms, and signs voluntarily without inducement.

Note: This release is enforceable upon execution by the Parent or Legal Guardian. The signed PDF will include a signature line for the Property Owner provided for property owner records and acknowledgment — the release does not require Property Owner counter-signature to be legally binding.

Photo & Media Release

This one is optional. If you sign, Lucky Little Riders may share photos and videos of your rider on Instagram, our website, marketing materials, and similar uses. If you skip it, your rider can still take lessons — we just won't share photos of them publicly.

Lucky Little Riders LLC — Photography, Video, and Media Release

This Photography, Video, and Media Release is entered into between Lucky Little Riders LLC and the undersigned Parent or Legal Guardian on behalf of the minor rider(s) identified above. This Release governs the creation and use of photographs, videos, and other media of the Rider(s) in connection with their participation in lessons, programs, clinics, competitions, demonstrations, social events, and other activities offered or conducted by Lucky Little Riders ("Activities").

1. Grant of Rights. In consideration of Rider's participation in the Activities, Parent grants to Lucky Little Riders LLC and its owners, members, employees, agents, contractors, licensees, successors, and assigns (the "Lucky Little Riders Parties") the irrevocable, perpetual, royalty-free, non-exclusive, worldwide right and license to photograph, film, video record, and audio record the Rider, and to use, reproduce, edit, modify, adapt, distribute, publish, publicly display, and publicly perform such Media in any and all formats and media now known or hereafter developed.

2. Permitted Uses. (a) Lucky Little Riders' website and any successor sites; (b) social media accounts including Instagram, Facebook, TikTok, YouTube and any successor platforms; (c) promotional, marketing, and advertising materials in any medium; (d) brochures, flyers, signage, and printed collateral; (e) training, instructional, and educational materials; (f) press releases and editorial content; (g) submissions to industry publications, equine organizations, and competitions.

3. No Compensation. Neither Parent nor Rider is entitled to any compensation, royalty, fee, or remuneration of any kind for the creation or use of the Media, now or in the future.

4. Waiver of Right of Inspection or Approval. Parent expressly waives any right to inspect, review, or approve the finished Media, the editorial copy, captions, or the printed or digital materials in which the Media may appear.

5. Waiver of Right of Publicity (California Civil Code §3344). Parent has been advised of and understands the right of publicity protections set forth in California Civil Code §3344. PARENT EXPRESSLY WAIVES ANY AND ALL CLAIMS UNDER CALIFORNIA CIVIL CODE §3344 OR ANY OTHER STATUTORY OR COMMON LAW RIGHT OF PUBLICITY, PRIVACY, OR LIKENESS, ARISING OUT OF OR RELATING TO THE LUCKY LITTLE RIDERS PARTIES' CREATION OR USE OF THE MEDIA AS DESCRIBED IN THIS RELEASE. (Initials required.)

6. Waiver of Unknown Claims (California Civil Code §1542). Parent has read and understands the following provision of California law: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." PARENT EXPRESSLY WAIVES THE PROTECTIONS OF CALIFORNIA CIVIL CODE §1542 WITH RESPECT TO ALL CLAIMS RELATED TO THE MEDIA, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, AS OF THE DATE PARENT SIGNS THIS RELEASE. (Initials required.)

7. Indemnification. Parent agrees to defend, indemnify, and hold harmless the Lucky Little Riders Parties from any claims, demands, losses, damages, liabilities, costs, and expenses arising out of or relating to: (a) Parent's or Rider's breach of this Release; (b) any claim by any third party that the use of the Media violates such third party's rights; or (c) any inaccuracy in Parent's representations.

8. Authority to Bind Minor. Parent represents and warrants that Parent is the lawful parent or legal guardian of Rider, has full legal authority to grant the rights and waivers set forth in this Release on Rider's behalf, and that no other person's consent is required.

9. Withdrawal of Consent for Future Media. Parent may withdraw consent to the creation of future Media by providing written notice (email to Lucky Little Riders' designated email address shall be sufficient). Withdrawal applies only to Media created after the date Lucky Little Riders receives the notice and does not affect rights granted with respect to Media already created.

10-14. Standard Terms. This Release operates alongside the Lucky Little Riders Youth Riding Instruction Agreement and the Landowner Equestrian Hold Harmless and Release of Liability. Each agreement is independently enforceable. Severability applies. Governed by California law, with exclusive venue in Ventura County, California courts. Prevailing party in any action recovers reasonable attorneys' fees and costs.

15. Acknowledgment. PARENT HAS READ THIS RELEASE IN ITS ENTIRETY, UNDERSTANDS ITS TERMS, HAS HAD THE OPPORTUNITY TO ASK QUESTIONS AND TO CONSULT WITH INDEPENDENT LEGAL COUNSEL, AND SIGNS IT VOLUNTARILY AND OF PARENT'S OWN FREE WILL, WITHOUT ANY INDUCEMENT OR DURESS.
